A. Handling of personal data

In the following, we would like to inform you about how we handle personal data when you use this website. Unless otherwise described in the following sections, the legal basis for the processing of your personal data comes from the necessity of processing for the provision of the functions requested by you on this website (Art. 6(1)(b) General Data Protection Regulation).

1. Definitions

The terms "personal data" or "data" refer to all information relating to an identified or identifiable natural person. An "identifiable" natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

"Data subject" means an identified or identifiable natural person such as you, for example.

"Controller" refers to the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.

"Processing" or "process" refers to all manual or automated procedures or series of procedures carried out in connection with the processing of personal data, such as collection, collation, organisation, assignment, storage, adaptation or modification, selection, retrieval, use, granting of access by transmission, dissemination or other means of making data available, comparison, linking, restriction or deletion. Processing refers to the corresponding activity.

"Processor" means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

2. Using and visiting our website

2.1 Visiting our website

When you visit our website, your browser transmits certain data to our web server for technical reasons in order to provide you with the information you have called up. 

To enable you to visit the website, the following data is collected and temporarily stored in a log file and used:

  • Date and time of your visit
  • Time zone difference to Greenwich Mean Time (GMT)
  • Content of the request (specific page)
  • Operating system and its access status / HTTP status code
  • Website from which you visited our website (the so-called referrer URL)
  • Amount of data transferred
  • Browser, language and version of the browser software

We process this data in order to guarantee the correct display, use, stability and security of our website. The temporary storage of the above-mentioned data serves to protect our legitimate interests in order to allow us to arrange for the derivation of personal data in the event of unauthorised access or attempted access to our servers (Art. 6(1)(f) General Data Protection Regulation).

2.2 Contacting us via the contact form

If you have any questions about our products or other matters, you can contact us using the contact form (link top right). In this context, we process your personal data, 

  • first name and surname,
  • contact details (including telephone number, e-mail address),
  • company details (details of your company and your position), 

so that we can answer your enquiry individually. 

The processing of your data is either necessary to carry out pre-contractual measures with you (Art. 6 para. 1 sentence 1 lit. b GDPR) or is based on our legitimate interest in responding to your enquiry (Art. 6 para. 1 sentence 1 lit. f GDPR).

2.3 Contact via e-mail

If you have any questions about our products or other enquiries, you can also contact us by e-mail. We then process your data, i.e. your e-mail address, destination address, IP address, e-mail program, the date and time of your e-mail, the content of your e-mail and the information you have provided, so that we can answer your enquiry individually.

The processing of your data is either necessary to carry out pre-contractual measures with you (Art. 6 para. 1 sentence 1 lit. b GDPR) or is based on our legitimate interest in responding to your enquiry (Art. 6 para. 1 sentence 1 lit. f GDPR).

2.4 Information and advertising

You can provide us with your personal data both digitally via our website and on site at trade fairs using our contact card in order to receive information and advertising about current products and services from us as well as information about access to HELM AG's digital platform for farm management by post, telephone or e-mail. Depending on your information, we process the following data:

  • First name, surname, title
  • Address
  • Your preferred contact details (phone no., mobile, e-mail)
  • Your preferences for cultivated crops
  • Your professional sector

We use the double opt-in procedure for sending information and advertising. This means that we will only send you information and advertising by e-mail if you confirm this after providing your e-mail address via an e-mail sent by us and a link contained therein.

The purpose of collecting the personal data listed above is to send you information and advertising tailored to your target group. The legal basis for the processing of your data is your consent (Art. 6 para. 1 sentence 1 lit. a GDPR).

We use the service provider Salesforce to provide information and advertising. The data is transferred to Salesforce (Salesforce.Com Germany GmbH, Erika-Mann-Straße 31, 80636 Munich) and processed there for the creation of distribution lists and the target-group-orientated selection of recipients of certain information and advertising. We have concluded an order processing contract with Salesforce. Salesforce processes your personal data in the USA on the basis of additionally agreed standard contractual clauses in accordance with Art. 46 para. 2 lit. c GDPR. In addition, Salesforce also undertakes to comply with an appropriate level of data protection when processing data outside the European Union by means of binding internal data protection regulations in accordance with Art. 46 para. 2 lit. b GDPR (so-called binding corporate rules).

3. Use of cookies

3.1 What cookies are

We use "cookies" on our website. These are small text files that are stored on your computer or other end devices such as your smartphone or tablet. Cookies store certain information (e.g. your preferred language or page settings), which can be sent back to us by your browser when you visit the website again (depending on the lifespan of the cookie). Cookies help us to design our website so that it meets the needs of users and to optimise it continuously. We also analyse how you use our website so that we can improve it to better match your interests.
 

3.2 Which cookies we use

We use so-called technical cookies – absolutely necessary cookies, without which the functionality of our website would be limited – and optional cookies for the purposes of website analysis and marketing.

Session cookies show us, for example, if you have already visited individual pages on our website. Session cookies are automatically deleted when you leave our website.

We also use temporary cookies, which are temporarily stored on your computer or other end device. These cookies show us the data you entered on a previous visit to our website and which settings you have selected; this means that you do not need to do this again.

We also use tracking cookies to statistically record the use of our website in order to optimise our website.

The use of cookies by us may involve the processing of your personal data; i.e. your IP address and information about what interactions you have with our website. The processing of your data in connection with your use of our website for the above-mentioned purposes is based on our legitimate interest in fulfilling the purposes mentioned above and below (Art. 6 para. 1 sentence 1 lit. f GDPR) and/or – where required by law – your consent (Art. 6 para. 1 sentence 1 lit. a GDPR).


3.3 Subject to your consent 

The processing of personal data by Usercentrics is based on Art. 6 para. 1 lit. f GDPR. This authorisation permits the processing of personal data within the scope of the "legitimate interest" of the controller, unless your fundamental rights, freedoms or interests prevail. Our legitimate interest lies in analysing the use of our website.

The data provided and used is collected and stored in a completely anonymised form. This data may also be stored outside Germany or the European Union.

When implementing and using analysis tools and tracking technologies, we anonymise personal data as quickly as possible either on the part of the provider, governed by corresponding contracts, or as part of our initial use, so that the right to information on your part cannot be exercised for all of the technologies listed below.

You can prevent the transmission of such data by implementing the appropriate settings in your browser or the apps or the operating system environment for this, but this may lead to problems when calling up, operating or using the content or service offered.
 

4. External services and content on our website services 

We integrate external services or content on our website. If you use such a service or if third-party content is displayed to you, communication data is exchanged between you and the respective provider for technical reasons.

In addition, the provider of the respective services or content may process your personal data for other purposes of its own. We have configured services or content from providers that are known to process data for their own purposes to the best of our knowledge and belief in such a way that either communication for purposes other than the presentation of the content or services on our website does not take place or that communication only takes place when you actively decide to use the service. However, as we have no influence on the data collected by third parties and its processing by them, we cannot provide any binding information on the purpose and scope of the processing of your personal data.

Matomo

Matomo Analytics is an analysis program that allows us to analyse user flows on our website. This serves the purpose of quality assurance and optimisation for our website.

Matomo enables us to analyse user flows on our website (e.g. number of visits, pages visited, length of stay on individual pages, visitor analysis, etc.). 

LinkedIn

We have a profile on LinkedIn. The provider is LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland. LinkedIn uses advertising cookies.

YouTube

We have integrated a YouTube video into our German online offer, which is stored on www.YouTube.com and can be played directly from our website. The video is embedded in "extended data protection mode", i.e. no data about you as a user is transferred to YouTube if you do not play the video.

By visiting the website, YouTube receives the information that you have accessed the corresponding subpage of our website. In addition, the data collected during the informational visit to our website is transmitted. This takes place regardless of whether YouTube provides a user account through which you are logged in or whether no user account exists. If you are logged into Google, your data will be assigned directly to your account. If you do not wish to be associated with your profile on YouTube, you must log out before activating the button. YouTube stores your data as user profiles and uses them for the purposes of advertising, market research and/or the customised design of its website. Such an evaluation is carried out in particular to provide needs-based advertising and to inform other users of the social network about your activities on our website. You have the right to object to the creation of these user profiles, and you must contact YouTube to exercise this right.

By integrating the YouTube video into our online presence, a connection to the Google DoubleClick network is automatically established when our website is accessed. Cookies are not set in the browser as a result of this. However, if DoubleClick cookies are already stored in your browser, these will be transmitted as part of the enquiry. According to the information provided by YouTube, data is only transferred when you play the video.

Vimeo

We use a video player service from Vimeo Inc., 555 West 18th Street, New York, New York 10011, USA, to show webinars. This processing is based on Art. 6 para. 1 lit. f GDPR. We use it to pursue our legitimate interest in enhancing your user experience and optimising our services.

When using the service, your browser communicates directly with Vimeo Inc. For more information, please refer to the Vimeo Inc. privacy policy, available at vimeo.com/privacy. There you will find information about your rights and data protection settings.

5. Access to your data by and transfer to third parties 

The staff of HELM AG and of HELM subsidiaries have access to your data.

We also commission third parties to process data on our behalf (as data processors). In such cases, their contractual relationships with us are subject to the requirements of applicable data protection law.

We pass on data that is necessary for the realisation of consignments to our transport service providers.

Otherwise, your data will not be transferred to third parties (as data controllers) unless we notify you of this separately in advance and such data transfer to third parties is permitted under an applicable legal provision (e.g. your express consent, the performance of a contract or on the basis of other legal provisions), or we are legally obliged to provide this data in order to comply with an applicable legal provision.

6. Data retention period

In principle, we only store personal data until the originally intended and authorised purpose of storage and retention has been fulfilled.

Notwithstanding the above general principle, data will not be deleted if information is necessary to fulfil a legal requirement with which we are obliged to comply. For example, we are subject to data retention regulations under commercial and tax law, which may require the storage of certain data for a period of up to ten years in accordance with local law.

7. Security of your data

To protect the security of your personal data, we have taken appropriate technical and organisational measures in accordance with Art. 32 GDPR. We take technical and organisational security measures to ensure that our personally identifiable information is protected against loss, manipulation, destruction and unauthorised access. Our security measures are constantly being improved in line with technological developments.

  • the right to information about and access to your data processed by us (Art. 15 GDPR);
  • the right to rectification and completion of your personal data processed by us (Art. 16 GDPR);
  • the right to erasure (Art. 17 GDPR) or restriction of processing (Art. 18 GDPR) of your personal data processed by us; 
  • the right to data portability (Art. 20 GDPR);
  • the right to lodge a formal complaint with the competent supervisory authority;
  • the right to withdraw your consent to the processing of your personal data at any time.
  • As well as the right under the provisions of Art. 21 para. 1 and Art. 21 para. 2 GDPR to refuse the processing of your personal data, which is carried out in the pursuit of our legitimate interests (Art. 6 para. 1 no. 1f GDPR), at any time.
